These terms and conditions govern the sale of goods and services by Garden Building Co Ltd, referred hereon as ("we") and to the person, firm or company purchasing or ordering goods to hereon as ("you").
These terms and conditions constitue the entire and only agreement between us and supersede all previous agreements, our acceptance of your order by delivery or collection of the goods constitue a legally binding contract between us on these terms and conditions.
All prices for goods and services are inclusive of VAT.
The price payable by you is as set out on our price lists at the time you place your order.
We reserve the right to revue or amend our prices without prejudice to you.
Prices quoted do not include delivery costs, these are available at the time of order.
All delivery dates are estimates only and the time of delivery shall not under any circumstances be of the essence.
Risk in the goods passes to you on delivery/collection.
Delivery is to the kerbside only, we will not accept any liability for damage to you or your property upon invitation by you to proceed beyond this point.
All damages, shortfalls must be reported to us within 7 days of delivery/collection.
It is the responsibility of you to ensure the goods ordered are correct in type and quantity.
A 20% deposit is required to order non-stock items, which cannot be refunded if the goods are subsequently not collected or delivered.
Special offers, clearance, end of line and full pack discounted goods cannot be returned for refund.
Any goods returned by you for reasons other than those that are covered by our responsibility will be subject to a 20% restocking charge, and will only be accepted by us if they are in the condition as when delivered.
Goods that have to be collected by us for return will be subject to an uplift charge (available at the time of request), unless we are delivering replacement goods.
This returns policy forms part of our terms and conditions, copies of which are available on request.
This dos not affect your statutory rights as a customer.
You upon ordering garden buildings to be installed by us or any of our suppliers are to prepare your own base and to ensure its suitability. If on arrival the base is found to be unsatisfactory then we will either leave the building for you to erect, but we will still charge the installation fee or we will come back with the building another day but we will have to charge the installation fee twice. If we are forced to put the building onto what we consider an unsuitable base, we cannot take responsibility for faults incured by this i.e sticking doors, twisting etc.
You are reminded that wood is a natural product and will tend to move, shrink in dry conditions. This dos not effect the strength of timber and is a totally natural process, which we cannot be held respnsible.
We cannot take responsibility for the phenomenon of effloresence, which may occur, in the form of a deposit and/or apparant colour fading in the form of patches and drip staining. This occasional and naturally occuring phenomenon is inherrant in all concrete products with high cement content and is beyond our control.
We shall have no liability to you for any failure or delay in supply or delivery that is caused by an event or circumstance beyond our reasonable control.
We may suspend further supply or delivery, stop any goods in transite or terminate our contract by notice in writing to you if you are in breach of an obligation hereunder or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankcruptcy or insolvency. Upon termination, you indebtedness to us becomes immediatley due and payable and we shall be under no obligation to supply goods to you.
This contract will be governed by and interpreted in accordance with English law, this dos not affect your statutoty rights as a consumer.
